Welcome to Jeez Louize! We're glad you're here. The terms "we," "us," and "our" refer to Jeez Louize, operated by Betty Sue Tattoo. We run this store and website — including all related information, content, features, tools, products, and services — to give you a curated shopping experience (the "Services"). Jeez Louize is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced here (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use our Services.

We've done our best to represent our products accurately in our store. That said, colours and appearance may look slightly different depending on your device and screen settings.

We don't guarantee that the appearance or quality of any product you purchase will exactly match how it's shown in our store.

Product descriptions may change at any time, without notice, at our discretion. We also reserve the right to discontinue any product or limit quantities available to any person, geographic region, or jurisdiction, on a case-by-case basis.

Section 3 – Orders

Placing an order is an offer to purchase — not a guaranteed sale. Jeez Louize may accept or decline your order for any reason, at our discretion. Your order isn't accepted until we confirm it, and we must receive and process your payment before it's accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests once an order has been accepted. If we don't accept, change, or cancel an order, we'll try to notify you using the email, billing address, and/or phone number you provided when the order was placed.

Purchases are subject to return or exchange solely in accordance with our Return Policy.

By placing an order, you confirm your purchase is for your own personal or household use, and not for commercial resale or export.

Section 4 – Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed, and will be set out in your order confirmation email. Unless otherwise stated, posted prices do not include taxes, shipping, handling, customs, or import charges.

Prices in our online store may differ from prices offered in physical stores or in other online or third-party stores. We may run promotions from time to time that affect pricing and are governed by their own terms and conditions, separate from these Terms. If there's a conflict between promotion terms and these Terms, the promotion terms will govern.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made in our store, and to promptly update this information — including your email address and payment details — so we can complete your transactions and contact you as needed.

You represent and warrant that: (i) any payment information you provide is true, correct, and complete; (ii) you are duly authorised to use the payment method provided; (iii) charges incurred by you will be honoured by your payment provider; and (iv) you will pay all charges incurred at the posted prices, including shipping and handling and any applicable taxes.

Section 5 – Shipping and Delivery

We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

Section 6 – Intellectual Property

Our Services — including all trademarks, brand elements, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement of these — are owned by Jeez Louize, its affiliates, or its licensors, and are protected by applicable patent, copyright, and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent. Except as expressly stated here, nothing in these Terms grants or should be read as granting any licence or right under any patent, trademark, copyright, or other intellectual property belonging to Jeez Louize, Shopify, or any third party. Unauthorised use of the Services may violate applicable intellectual property laws. All rights not expressly granted here are reserved by Jeez Louize.

Jeez Louize's names, logos, product and service names, designs, and slogans are trademarks of Jeez Louize, its affiliates, or licensors. You must not use these trademarks without our prior written permission. Shopify's name, logo, and related marks are trademarks of Shopify. All other names, logos, and marks on the Services belong to their respective owners.

Section 7 – Optional Tools

You may be given access to customer tools offered by third parties as part of the Services. We don't monitor or control these tools.

You acknowledge that we provide access to such tools "as is" and "as available," without any warranties, representations, or endorsement of any kind. We have no liability arising from or relating to your use of optional third-party tools.

Jeez Louize is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Jeez Louize. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Jeez Louize, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Jeez Louize.

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read both.

We may, but are not obligated to, monitor, edit, or remove Feedback that we determine, at our sole discretion, to be unlawful, offensive, threatening, defamatory, pornographic, obscene, or otherwise objectionable, or that violates any party's intellectual property or these Terms.

You agree that your Feedback won't violate any third party's rights, including copyright, trademark, privacy, or other personal or proprietary rights, and won't contain unlawful, abusive, or obscene material, or any virus or malware. You may not use a false email address, impersonate anyone else, or otherwise mislead us or third parties about the origin of your Feedback. You also agree not to: (a) upload or transmit viruses or other malicious code that could affect the functionality of the Services; (b) reproduce, duplicate, copy, extract, sell, resell, or exploit any part of the Services; (c) collect or track others' personal information; (d) spam, phish, pharm, or pretext the Services; (e) use bots, scrapers, data extraction tools, AI agents, or other automated means to access the Services; or (f) interfere with, bypass, or circumvent our security or authorisation measures. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine you've violated these Terms.

Agents must: (i) identify themselves as an Agent in all HTTP/HTTPS requests by including "Agent/[agent name]" in the request's user agent string; (ii) not conceal or obfuscate that any access, use, or interaction is from an Agent, including by mimicking human behaviour or completing/circumventing CAPTCHAs; (iii) respond truthfully to any prompt seeking to determine whether an interaction is coming from a human or a computer; and (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control how Agents access, use, or interact with the Services.

We may terminate this agreement or your access to the Services, in whole or in part, at our sole discretion and without notice. You'll remain liable for all amounts due up to and including the date of termination.

The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.

We don't warrant the accuracy, completeness, or usefulness of this information, and any reliance you place on it is at your own risk. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THIS DISCLAIMER MAY NOT APPLY TO YOU IN FULL, AND YOU MAY HAVE ADDITIONAL RIGHTS UNDER MANDATORY CONSUMER PROTECTION LAW.

Section 17 – Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JEEZ LOUIZE, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS — OR THOSE OF SHOPIFY AND ITS AFFILIATES — WILL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THIS SECTION LIMITS ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE MANDATORY LAW, INCLUDING BELGIAN AND EU CONSUMER PROTECTION LAW.

Section 18 – Indemnification

You agree to indemnify, defend, and hold harmless Jeez Louize, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims — including reasonable legal fees — arising from: (1) your breach of these Terms or the documents they incorporate by reference; (2) your violation of any law or a third party's rights; or (3) your access to and use of the Services.

We'll notify you of any indemnifiable claim; a failure to promptly notify you won't relieve you of your obligations unless you are materially prejudiced as a result. We may control the defence and settlement of such a claim at your expense, including choice of counsel, but we won't settle any claim requiring a non-monetary obligation from you without your consent, which won't be unreasonably withheld. You agree to cooperate in the defence of any indemnified claim, including by providing relevant documents.

Section 19 – Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will still be enforced to the fullest extent permitted by applicable law, and the unenforceable portion will be considered severed from these Terms. This won't affect the validity or enforceability of the remaining provisions.

Section 20 – Waiver; Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms doesn't constitute a waiver of that right or provision.

These Terms, together with any policies or operating rules we post on our site or in relation to the Services, form the entire agreement between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications, or proposals — oral or written — between you and us, including any earlier versions of these Terms.

Any ambiguity in interpreting these Terms won't be construed against the drafting party.

Section 21 – Assignment

You may not delegate, transfer, or assign this agreement or any of your rights or obligations under these Terms without our prior written consent; any such attempt will be void. We may transfer, assign, or delegate these Terms and our rights and obligations without your consent or notice.

Section 22 – Governing Law

These Terms of Service, and any separate agreements under which we provide you Services, are governed by and construed in accordance with the laws of Belgium. You and Jeez Louize agree to submit to the exclusive jurisdiction of the courts of Belgium. If you are a consumer residing in another EU member state, this choice of law does not deprive you of the protection afforded by the mandatory consumer protection provisions of the law of your country of residence.

The headings used in this agreement are included for convenience only and don't limit or otherwise affect these Terms.
